1. Agreement to Terms

By accessing or using the website at https://simplybuiltwebsites.com or purchasing a web design, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, you are prohibited from using our services.

2. Description of Service

Simply Built Websites provides standardized web design packages including Basic, Pro, and Scale tiers. Each tier includes specific features as outlined in the Offer Catalog on our Site.

Custom Builds: We offer specialized solutions for projects requiring unique functionality (e.g., e-commerce, advanced booking engines, or multi-page systems exceeding the Scale tier). Custom Builds are handled as independent projects; pricing, timelines, and specific deliverables will be defined in a separate Statement of Work provided during the quote process.

3. Client Obligations

To maintain our delivery timelines, you agree to:

• Provide all necessary text, images, and branding materials via our standardized intake form.
• Provide feedback and approvals in a timely manner.
• Ensure you own the rights to all content provided for use on your website.

4. Payments and Refunds

• Flat-Rate Fees: You agree to pay the full price of the selected Blueprint at the time of order. Custom Builds may require a deposit as outlined in the specific project quote.
• Payment Processing: Payments are processed securely via third-party providers. We do not store full credit card details.
• Refund Policy: Due to the digital nature of our work and the immediate allocation of resources, refunds are not provided once the design process has begun.

5. Delivery Timeline

We aim for a "Handshake to Homepage" turnaround of 7 days for standard designs. This timeline begins only once we have received your completed intake form and all required assets. Custom Builds do not fall under the 7-day guarantee; their specific timelines will be estimated during the quoting phase.

6. Optional Care Plan

The "Care Plan" is an optional, month-to-month service priced at $49/mo.

• Services: Includes hosting, SSL maintenance, and minor content updates.
• Cancellation: You may cancel the Care Plan at any time with 30 days' notice.
• Termination: If the Care Plan is cancelled, you are responsible for migrating your website to a new hosting provider. Simply Built Websites is not responsible for site downtime following termination.

7. Intellectual Property

Upon final payment, you own the content and visual design of your website. Simply Built Websites retains ownership of any proprietary code, frameworks, or structures used to build the site. We reserve the right to display your completed project in our portfolio.

8. Limitation of Liability

Simply Built Websites provides high-performance sites but does not guarantee specific search engine rankings or business revenue. We are not liable for any indirect, incidental, or consequential damages resulting from the use of our services or site downtime.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved in the courts of San Diego, CA.
